I am an attorney and required to maintain confidentiality of all client information. I protect your personal information related to SMS through this policy. This SMS Privacy Policy governs how I treat personal information collected and received from you in connection with your use of the SMS Service, which I make available through a third-party service provider. This SMS Privacy Policy is incorporated into my compliance with the Rules of Professional Conduct, which includes, among other things, privacy of client information.


Please read this policy carefully. By entering into a written attorney client fee agreement with me, which includes authorization to use the SMS Service, you agree to the terms of this Policy. This policy may change from time to time, and your continued use of the SMS Service constitutes acceptance of those changes.


I NEVER MAKE A "TELEPHONE SOLICITATION" AS THAT TERM IS DEFINED IN THE TELEPHONE CONSUMER PROTECTION ACT, 47 USC SECTION 227(A)(4). A "TELEPHONE SOLICITATION" UNDER THE TCPA WOULD BE A VIOLATION OF THE RULES OF PROFESSIONAL CONDUCT FOR A PENNSYLVANIA LAWYER.


Eligibility


You must be 18 years or older to receive text messages from Christopher K. McNally, Attorney at Law. You must first enter into a written fee agreement and be a client of Christopher K. McNally to receive a text message. Non-clients are not eligible to receive a text message.


Consent to Receive Text Messages


If you choose, you can provide your mobile phone number to receive text messages from Christopher K. McNally, such as case status or case activity. I do not provide any alerts or notifications regarding goods or services offered for sale. I never use SMS to request or accept payment for my legal services. I never use SMS for automated text messages. I do not and will not respond by SMS to an inquiry regarding the legal services that I offer. If you enter into a written agreement to retain my professional services, and if you also provide your mobile phone number, your written fee agreement will include a provision that expressly consents to receive automated text messages from me at the number provided. Consent is always required to retain my legal services. Standard message and data rates may apply, and you should check with your mobile carrier for applicable rates.


Message Delivery


Text messages are sent via third-party mobile network providers. I cannot control certain factors related to message delivery. Depending on the mobile carrier, it may not always be possible to successfully transmit the text message to the recipient; nor is content available on all carriers. I do not guarantee the availability or performance of this service, including any liability for transmission delays or message failures.


Message Frequency


Message frequency varies depending on activity in the matter in which I represent you.


Opting Out


If you no longer wish to receive text messages regarding the matter in which I represent you, you can opt-out by texting STOP to the SMS number used by Christopher K. McNally, Attorney at Law. Upon doing so, you will receive a confirmation message, and no further text messages will be sent to you from (412) 228-4414 unless you choose to re-subscribe to my text messaging services. Opting out of text messaging services will also constitute grounds for termination of the attorney-client relationship for cause pursuant to the written fee agreement that you sign.
